1. About PukuPlan
PukuPlan is an online platform designed to help users organise recipes, meal plans, pantry items, shopping lists, and related food-planning information.
In these Terms, “PukuPlan”, “we”, “our”, and “us” refer to the operator of the PukuPlan service. “You” and “your” refer to the user of the service.
2. Eligibility and Account Use
You must be at least 18 years old, or otherwise legally capable of entering into binding terms in your location, to use PukuPlan.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate account information and keep it reasonably up to date.
3. Licence to Use the Service
Subject to these Terms, PukuPlan grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the service for your personal or internal business use.
This licence does not transfer any ownership rights in the platform, software, branding, content, or intellectual property of PukuPlan.
4. Acceptable Use
You agree not to misuse the service. Without limitation, you must not:
- Use PukuPlan for any unlawful, fraudulent, deceptive, or harmful purpose
- Interfere with, disrupt, damage, disable, or impair the service or related systems
- Attempt to gain unauthorised access to any account, system, or data
- Reverse engineer, decompile, copy, scrape, or exploit any part of the service except as permitted by law
- Upload or transmit viruses, malicious code, or harmful material
- Use automated tools to access the service in a manner that places unreasonable load on the platform
- Use the service to store, publish, or distribute material that is illegal, offensive, defamatory, threatening, hateful, obscene, or abusive
- Harass, abuse, threaten, intimidate, or mistreat other users, our staff, or service providers
- Use vulgar, obscene, discriminatory, hateful, or excessively abusive language in content submitted to or through the service
- Impersonate any person or falsely represent your identity or affiliation
- Use PukuPlan in a way that infringes the rights of others, including privacy, confidentiality, or intellectual property rights
We may suspend, restrict, or terminate access where we reasonably believe a user has breached these Terms or created risk to the service, other users, or third parties.
5. User Content
You may submit, upload, create, or store content in PukuPlan, including recipes, notes, meal plans, pantry records, shopping lists, comments, and similar material (“User Content”).
You retain ownership of your User Content. However, you grant PukuPlan a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, display, and use that User Content as reasonably required to operate, secure, improve, and provide the service.
You are solely responsible for your User Content and for ensuring that it is lawful, accurate, appropriate, and safe to store or use.
We are not responsible for reviewing all User Content and do not guarantee its accuracy, completeness, legality, safety, or suitability.
6. Food, Cooking, Nutrition and Allergy Disclaimer
PukuPlan is an organisational and informational tool only. It does not provide medical, dietary, nutritional, allergy, food safety, or professional cooking advice.
Recipes, ingredient lists, pantry data, substitutions, meal suggestions, cooking steps, storage information, expiry dates, shopping items, and related outputs may be incomplete, inaccurate, outdated, or unsuitable for your circumstances.
You are solely responsible for checking:
- Ingredients and allergen content
- Food labels and manufacturer information
- Expiry dates and product condition
- Safe food handling, preparation, cooking, and storage practices
- Suitability for medical conditions, allergies, intolerances, pregnancy, children, or other dietary needs
PukuPlan does not warrant that any recipe, meal plan, ingredient, substitution, or food-related information is allergen-free, safe, nutritionally appropriate, legally compliant, or fit for any particular purpose.
To the maximum extent permitted by law, PukuPlan is not liable for illness, allergic reaction, injury, adverse health outcome, contamination, spoilage, cooking failure, nutritional outcome, food poisoning, or any loss or damage arising from reliance on food-related content or outputs available through the service.
7. No Professional Advice
Information provided through PukuPlan is general in nature and is not a substitute for advice from a qualified doctor, dietitian, allergist, nutritionist, food safety professional, or other appropriate professional.
You should seek professional advice for any medical, allergy, dietary, nutritional, or health-related matter.
8. Availability and Service Changes
We may change, update, suspend, withdraw, or discontinue any part of the service at any time, with or without notice.
We do not guarantee uninterrupted availability, error-free operation, or that the service will always be secure, accurate, or compatible with your devices or systems.
9. Subscriptions, Billing and Paid Features
Some parts of PukuPlan may require payment or an active subscription. Where paid plans apply, pricing, billing frequency, renewal terms, and included features will be described at the point of purchase.
You authorise applicable charges for the selected plan in accordance with the payment terms presented to you at signup, checkout, or subscription management.
Failure to pay may result in suspension, downgrade, or cancellation of access to paid features.
10. Intellectual Property
The PukuPlan platform, including its software, structure, design, branding, text, graphics, functionality, and underlying technology, is owned by or licensed to PukuPlan and is protected by applicable intellectual property laws.
Except as expressly allowed by these Terms, you must not reproduce, distribute, modify, create derivative works from, publicly display, sell, or exploit any part of the service.
11. Suspension and Termination
We may suspend or terminate your access immediately if:
- You breach these Terms
- You misuse the service
- Your conduct creates legal, security, technical, or reputational risk
- We are required to do so by law or by a service provider
You may stop using the service at any time. Termination does not affect rights or obligations that arose before termination.
12. Disclaimers
To the maximum extent permitted by law, PukuPlan is provided on an “as is” and “as available” basis.
We do not make warranties or representations, express or implied, regarding:
- Accuracy, completeness, or reliability of content
- Availability, continuity, or performance of the service
- Suitability of the service for any particular purpose
- That the service will be free of defects, errors, or harmful components
13. Limitation of Liability
To the maximum extent permitted by law, PukuPlan and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive loss or damage, including loss of profits, revenue, goodwill, data, business opportunity, or expected savings.
To the maximum extent permitted by law, PukuPlan’s total aggregate liability arising out of or in connection with the service or these Terms will not exceed the amount you paid to PukuPlan for the service in the 12 months before the event giving rise to the claim, or AUD $100 if you have not made any payment, whichever is greater.
Nothing in these Terms excludes rights or remedies that cannot be excluded under applicable law, including any non-excludable rights under the Australian Consumer Law.
14. Indemnity
You agree to indemnify and hold harmless PukuPlan and its owners, officers, employees, contractors, affiliates, and service providers from and against claims, liabilities, damages, losses, costs, and expenses arising from:
- Your misuse of the service
- Your User Content
- Your breach of these Terms
- Your violation of any law or rights of a third party
- Your reliance on food, recipe, cooking, allergy, or nutritional content without independent checking
15. Privacy
Your use of PukuPlan is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.
16. Third-Party Services and Links
PukuPlan may integrate with or rely on third-party services such as authentication, hosting, email, payment, analytics, or other infrastructure providers.
We are not responsible for third-party services, content, websites, products, or policies, and your use of those services may be subject to separate terms.
17. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
18. Governing Law
These Terms are governed by the laws of Queensland, Australia, unless otherwise required by applicable law. You submit to the non-exclusive jurisdiction of the courts of Queensland and Australia in relation to disputes arising out of these Terms or the service.
